- The Builder’s performance of the Work is strictly contingent upon the Customer’s timely and diligent fulfillment of their obligations.
Critical factors beyond the Builder’s control include, but are not limited to:
- (a) The Customer’s timely decision-making and written approvals (which shall be provided within (3) business days of a request by the Builder);
- (b) The Customer’s active cooperation during the entire pre-construction and construction process;
- (c) The Customer’s timely completion and procurement of all necessary land use, environmental, and zoning approvals;
- (d) The Customer’s timely scheduling, supply, and approval of all land surveyor’s documents and plat plans.
Timeline Extension
Project timelines are primarily adjusted to account for external dependencies, such as client response times for critical decisions, and unavoidable weather disruptions. These variables heavily impact sensitive early-stage work, including land clearing, grading, and concrete foundation preparation and pouring.

- Land Clearing: Heavily forested per acre for dozing and grubbing – tree and root removal takes 120+ equipment operator man-hours (varies greatly on conditions, land location, weather conditions and equipment)
- Grade and Compact Cleared Land: Grading and compacting one acre of recently cleared, heavily wooded land typically requires 60+ equipment operator man-hours.
- Building Pad Site Prep: 1-5 days to Cut the building pad area, Grade, and Compact.
- Delivery to Jobsite: Red Iron Steel Package: Based on design and engineering complexity, and market conditions, shop fabrication and delivery times can span 16 weeks (minimum) to 20 weeks depending on supply chain variables.
- Concrete Foundation: 1-2 weeks to prep, inspect, pour, and finish.
- Concrete Curing Phase: 28-days (4-weeks) minimum. Required.
- Erection Complete: 2-3 weeks.
- Erection: ADD interior build-out, MEP and interior finishing 24-32 weeks.
